1. Service Terms
By accessing or using Shanetic services ('Services'), you agree to be bound by these terms. The Services are provided 'as is' and 'as available' without warranties of any kind, either express or implied.
2. Intellectual Property Rights
All rights, title, and interest in and to the Services, including all intellectual property rights, are and will remain the exclusive property of Shanetic and its licensors.
3. Data Processing
You grant Shanetic a worldwide, non-exclusive license to host, copy, transmit and display your data as necessary for us to provide the Services. You represent and warrant that you have all rights necessary to grant these rights.
4. Social Media Platform Integrations
Our Services may integrate with various social media platforms including but not limited to WhatsApp, Instagram, Facebook, TikTok, and LinkedIn. By using these integrations, you acknowledge and agree that: (a) you must comply with each platform's terms of service; (b) platforms may change their APIs or terms at any time which may affect our Services; (c) you authorize us to act on your behalf when interacting with these platforms; and (d) we are not responsible for any changes, limitations or discontinuation of these third-party platforms. You are responsible for understanding and complying with all platform-specific terms when using our integrated services. You must ensure you have all necessary rights to share any content through our Services, and you remain responsible for any communications you authorize to be sent through these platforms.
5. Limitation of Liability
To the maximum extent permitted by law, Shanetic shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Platform functionality may change without notice and we accept no liability for any resulting disruption or loss of functionality. Shanetic is not responsible for the availability, accuracy, or reliability of any third-party platform integration, and you agree to waive any claims against Shanetic arising from the use of or inability to use such integrations.
6. AI Services
Our AI technology processes communications to provide automated responses. While we strive for accuracy, we make no guarantees about the AI's responses. You are responsible for reviewing and verifying all AI-generated communications.
7. Governing Law and Dispute Resolution
These terms shall be governed by the laws of Colombia, without regard to its conflict of law principles. Any disputes shall be resolved exclusively in the courts of Colombia. You agree that any dispute arising from or relating to these terms, our Services, or your use of social media platform integrations will be resolved through binding arbitration in Colombia, in accordance with the rules of the Centro de Arbitraje y Conciliación of the Cámara de Comercio de Bogotá. The arbitration proceedings shall be conducted in Spanish. You expressly waive your right to participate in a class action lawsuit or class-wide arbitration against Shanetic.
